car accident hit from behind no independent witness,liability insurance only,the driver who hit me made up a story and his insurance company denied my claim simply based on conflicting stories from two drivers involved.my insurance firm said they had nothing to do.I do not have medical exam in time,so not much profit for lawyer,is small court claim the only solution?what I have are pictures of the damaged car I took later at home.Police report did not metioned the original scene of the accident only conflicting stories and no citation.
Your pretty much screwed….you could try to take him to court but I think you will be wasting your time. If the report doesn’t back you then the judge will just rule that its a 50/50 split. Its also possible that he could countersue you and the judge could rule against you….I would see if your insurance company is willing to try to contact his on your behalf.
